ADD Claim Was Denied Due to an Alleged Attempt to Commit a Misdemeanor

Our client called us to discuss his denied accidental death claim following the untimely death of his wife. His wife worked for a company that provided group life insurance coverage with accidental death benefits. Tragically, she died when her car suddenly rolled over and hit a concrete median.

The insurance company denied the claim by alleging that the commission of a misdemeanor exclusion applied. The insurance company claimed that the insured failed to maneuver a curve in the highway and would have been issued a citation had she survived the accident.

When our attorney took over the case, we discovered that other factors caused the accident. We filed a timely appeal with the insurance company. The insurance company reversed its denial on appeal and promptly paid the claim with interest, including airbag and seat belt benefits. Our client was very pleased with the fast outcome in his favor.
